The licensee(s) or an employee of the licensee(s) will be present in or on the patio/terrace/other area at all times that alcoholic beverages are being served or consumed.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio/terrace/other area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

Sales and service of alcoholic beverages on said patio/terrace/other area shall be restricted to waiter/waitress service and only to patrons seated at a table.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises, except the licensed patio(s) under the control of the licensee(s).

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

The monthly gross sales of alcoholic beverages shall not exceed the monthly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a monthly basis and shall be made available to the Department on demand.
