Operating Restrictions:
No alcoholic beverages shall be consumed on any property adjacent to the licensed premises.
No noise shall be audible beyond the area under the control of the licensee.
The petitioner shall not allow its patrons or the general public to loiter or congregate on any sidewalks adjacent to their licensed premises.
The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.
The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.
The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledges that incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.
During normal meal hours, the premises shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public. Normal meal hours constitute of Breakfast, 6:00 a.m. to 9:00 a.m., Lunch, 11:00 a.m. to 2:00 p.m., Dinner, 6:00 p.m. to 9:00 p.m.
