Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

The premises shall be open for business no later than 10:00 am and be prepared to serve the food listed in the menu at all times that the premise is open.

Customers and the general public shall be informed that the primary business of the establishment is the sale of food, which shall include but not limited to, providing each customer with a menu, posting signs on the premises, and advertising the food service.

During normal meal hours, the premises seating shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.

The sale of malt beverages and/or wine for consumption off the premises is strictly prohibited.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated (8/17/2023) and ABC-253 dated 8/17/2023).

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated (8/17/2023) and ABC-253 dated (8/17/2023).

No pool or billiard tables may be maintained on the premises.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.
