Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 am and 1:00 am each day of the week.

Private/semi-private rooms constructed on the premises shall have the following characteristics: a. No physical obstruction, including but not limited to, planters, partitions or items of décor, shall be placed or attached to any section of the doors, or wall which covers any portion of the glass within the door or walls. b. No physical construction, including but not limited to, planters, partitions or items of décor, shall be placed or attached to any section of the doors, or wall which covers any portion of the glass within the door or walls. c. All doors and walls to said rooms shall be constructed in such a manner as to have at least a clear glass window in the upper portion of said door and wall which measures no less than 22 by 22 inches d. Doors of said rooms must allow the activities in the interior of the rooms to be easily discernible at all times. e. The lighting in said rooms will be sufficient to make discernible the activities in the interior of the rooms at all times. f. There shall be no "dimmer" type lighting controls in the interior of said rooms. g. Said rooms shall not contain refrigeration units of any type. h. All food and beverages served to patrons utilizing said rooms will be by way of waitress service only i. Said rooms shall be equipped with audio and video equipment sufficient for performances commonly associated with “Karaoke” style entertainment. j. Karaoke style entertainment must be available at all times in said rooms during the hours of operation of the premises. k. No obstruction other than clear glass, shall be attached, fastened or connected to either the partitions or ceiling to separate the booths/dining areas within the interior space of the licensed premises. l. Said obstructions partitions other than clear glass shall not exceed 54" in height.

Between the hours of 6:00 pm to one half hour after closing, the petitioner(s) shall provide at least one (1) state licensed security personnel in the parking lot and shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of their property by nearby residents. Said personnel shall be clothed in such a manner as to be readily identifiable as security.

Distilled spirits shall be sold by the individual drink only, sale of distilled spirits by the bottle is prohibited.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The main entry door(s) shall be kept closed at all times during the operation of the premises except to permit the normal ingress and egress of patrons, in case of emergency and to permit deliveries. Said door(s) not to consist solely of a screen or ventilated security door.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the most recently certified ABC-257 and ABC-253.

There shall be no entertainment dancing allowed on the premises. This condition shall no prohibit Karaoke.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

There shall be no amusement machines or video game devices in the premises at any time.

No pool or billiard tables may be maintained on the premises.

No employee or agent shall solicit or accept any alcoholic or non-alcoholic beverage from any customer while in the premises.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Customers and the general public must be informed that the primary business of the establishment is the sale of food which shall include but not limited to, providing each customer with a menu, posting signs on the premises and advertising the food service.

Food service, with available menu, shall be available until one (1) hour prior to closing time each day of the operation.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the most recently certified ABC-257 and ABC-253.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

At no time shall there be a minimum drink requirement.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 of being applied.

There shall be no bar or lounge area upon the licensed premises maintained for the purpose of sales, service or consumption of alcoholic beverages directly to patrons for consumption.

The license may not be surrendered for private parties or one licenses.

Petitioner(s) shall make no changes in the premises interior without prior written approval from the Department.

At no time shall there be a cover charge for admittance to the premises. The Karaoke room rental shall not be deemed a violation of this condition.
