Operating Restrictions:

Sales and service of alcoholic beverages shall be permitted only between the hours of 6:00 a.m. and 12:00 Midnight.

The sale of products, other than beer and wine, measured by gross receipts on an annual basis, shall exceed the annual sales of beer and wine products, measured by gross receipts.

The sale of any alcoholic beverages for consumption on the premises is prohibited.

There shall be no pool tables or coin operated amusement devices maintained on the premises is prohibited.

There shall be no exterior advertising of any type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

Although it is the desire of the Police Department that the licensee sell no domestic or malt beverages in less than six pack quantities, the licensee will not be so restricted providing that this aspect of the conditions is subject to an annual review by the Police Department. The review will assess the need for such a restriction. f it is the finding of the Police Department, upon this annual review, that such a restriction is appropriate, the licensee shall abide by that condition.

No wine, other than wine coolers, may be sold in less than 750 ml bottles. Wine coolers shall not be sold in less than four pack quantities. The alcohol content of wine, with the exception of "dessert" wine, shall not exceed 15%.

All ice shall be sold at or above prevailing prices in the area an in quantities of not less than 7 pounds per sale.

Licensee will maintain the property adjacent to the licensed premises and under the control of the licensee, clear of newspaper racks, benches, pay telephones, bicycle racks and other objects which encourage loitering.

Trash pick-up at the premises shall be made between the hours of 7:00 a.m. and 7:00 p.m.

The licensee shall be responsible for keeping the area adjacent to the premises over which the licensee has control and the off-street parking area free of litter.

There shall be no cups, glasses, or similar receptacle commonly used for the drinking of beverages, whether constructed of glass, plastic Styrofoam, or other material sold, furnished or given away at the petitioner's premises in quantities of less than 23, with the exception of disposable cups sold in conjunction with and as containers for soft drink beverages.

The petitioner shall not sell, offer for sale or display any magazine or other printed material which contains pictures depicting: a. Acts or simulated acts of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any sexual acts which are prohibited by law. b. Any person being touched, caressed or fondled on the breast, buttocks anus or genitals. c. Scenes wherein a person displays the vulva or the anus or the genitals. d. Scenes wherein artificial devices or inanimate objects are employed to depict, or drawings are employed to portray, any other prohibited activities described above.

The licensee shall ensure the presence or the immediate availability of uniformed security officer(s) upon the premises during all hours of operation.
