Petitioner agrees to comply with all provisions under 23038 of the Business and Professions Code.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

No "happy hour" type or reduced price alcoholic beverage promotion shall be allowed.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 a.m. and 10:00 p.m., seven (7) days a week.

The premises shall be maintained as a Bona Fide Eating Place and shall provide menu containing an assortment of foods normally offered in such restaurants.

Full and complete meals must be served whenever the privileges of the license are being exercised.

100% of the premises seating shall be designated and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.

The monthly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a monthly basis and shall be made available to the Department on demand.

At no time shall this premises operate as a public premises.

Loitering (loitering is defined as "to stand idly about; linger aimlessly without lawful business")is prohibited on any sidewalks or property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

The interior lighting maintained there shall be sufficient to make easily discernible the appearance and conduct of all persons and patrons in that portion of the premises where alcoholic beverages are sold, served, delivered or consumed.

The exterior of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the premises. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

Graffiti shall be removed from the premises and all parking lots under the control of the licensee within seventy-two (72) hours of application. If the graffiti occurs on a Friday or weekend day, or on a holiday, the licensee shall remove the graffiti within seventy-two (72) hours following the beginning of the next weekday.

Petitioner shall not make structural changes in the premises interior without prior written approval from the Department.

No noise shall be audible beyond the area under the control of the licensee(s) as depicted on the most recently certified ABC-257.
