Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:30 a.m. and 1:30 a.m., each day of the week.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 2/28/2022 and ABC-253 dated 2/28/2022.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 2/28/2022 and ABC-253 dated 2/28/2022.

The petitioner(s) shall provide 40 off-street parking spaces for vehicles for use by patrons of the premises.

There shall be no amusement machines or video game devices in the premises at any time.

There shall be no dancing permitted on the premises at any time.

Valet parking services shall be provided during all hours of operation

Valet parking attendants shall not park patrons' vehicles on the 600 block of Poinsettia Place or in the alleyway adjacent to the applicant's premises.

Between the hours of 7:00 p.m. and one-half hour after closing or at any time the premises are providing entertainment, the petitioner(s) shall provide a licensed uniformed security guard in the parking lot and shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of their property by nearby residents.

There shall be no nude, topless or bikini entertainment involving male or female performers permitted on the premises at any time.

The petitioner(s) shall not employ or use any person in the sale or service of alcoholic beverages in or upon the licensed premises while such persons in unclothed or in such attire, costume or clothing as to expose to view any portion of the female breast below the top of the areola or any portion of the pubic hair, anus, cleft of the buttocks, vulva or genitals.

The petitioner(s) shall not employ or use the services of any hostess or other persons to mingle with the patrons while such hostess or other is unclothed or in such attire, costume or clothing as described in paragraph (1) above.

The petitioner(s) shall not encourage or permit any person on the licensed premises to touch, caress or fondle the breasts, buttocks, anus or genitals or any other person.

Sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any sexual act which are prohibited by law. b. The touching, caressing or foundling on the breast, buttocks, anus or genitals. c. The displaying of the pubic hair, anus, vulva or genitals. c. Scenes wherein a person displays the vulva or the anus or the genitals. d. Scenes wherein artificial devices or inanimate objects are employed to depict, or drawings are employed to portray, any other prohibited activities described above.

The petitioner(s) shall not permit any person to remain in or upon the licensed premises who exposes to public view any portion of his or her genitals or anus.

The petitioner(s) shall not permit the showing of film still pictures, electronic reproduction, or other visual reproduction depicting: a. Acts or simulated acts of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any sexual acts which are prohibited by law. b. Any person being touched, caressed or fondled on the breast, buttocks anus or genitals. c. Scenes wherein a person displays the vulva or the anus or the genitals. d. Scenes wherein artificial devices or inanimate objects are employed to depict, or drawings are employed to portray, any other prohibited activities described above.
