Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 am and 1:30 am each day of the week.

The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

There shall be no pool tables or amusement devices maintained upon the premises at any time.

No pool or billiard tables be maintained on the premises.

Live entertainment on the premises shall be permitted only between the hours of 8:00 pm and 1:30 am each night of the week and shall be limited to one piano and one pianist playing non-amplified piano music. Said live entertainment shall no be audible beyond the premises.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

No portion of the restaurant shall be deemed to be "private," for the purpose of dispensing alcoholc beverages to selected patrons. At no time shall any form of membership card be a prerequisite for admission to the restaurant at large, or to any sub-portion of the restaurant.

There shall be no enclosed customer booths. If booths exist are separated by a partition, said partitions shall be no higher than 54 inches and shall be completely opened on at least one side.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The premises shall be maintained as a bona fide food restaurant and shall provide a menu containing an assortment of foods normally offered in such restaurants. The licensee shall prepare to serve foods listed on the menu until at least 10:00 pm on all days the premises is open for business.

The licensee shall furnish the premises with tables and chairs at which food may comfortably be consumbed and have cutlery, condiments and other eating utensils avaiable for use by patrons.

The licensee shall inform the customers that the primary business of the establishment is the sale of food which shall include, but not limited to providing each customer with a menu, posting of signs on the premises and advertising food service.

No employee or agent shall be permitted to accept money or any other thing of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee(s) provide or permit, or make available either gratuitous or for compensation, male or female persons who act as escorts, companions, or guests of and for the customers.

No employee or agent shall solicit or accept any alcoholic or non-alcoholic beverage from any customer while in the premises.

The licensee shall not sublet the premises to "promoters" for nightclub activity.

There shall be no "minimum drink" requirements of patrons.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The rear door(s) shall be kept closed at all times during the operation of the premises except in cases of emergency. Said door(s) not to consist solely of a screen or ventilated security door.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the most recently certified ABC-257 and ABC-253.

Trash pickup at the premises will be made no earlier than 7:00 am nor later than 7:00 pm.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

The rear parking lot gate adjacent to the alleyway shall be kept closed at all times during the operation of the premises except in cases of emergency and to permit deliveries.

The sales, service and consumption of alcoholic beverages shall not be permitted on the patio adjacent to the licensed premises under the control of the licensee as depicted on the most recently certified ABC-257.
