Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Full and complete meals must be offered and made available at all times the premises is exercising the privileges of its alcoholic beverage license, with the exception of the last ½ hour of operation each day.

No Distilled Spirits shall be sold by the bottle.

Petitioner(s) shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks.

Sales, service and consumption of alcoholic beverages shall be permitted in or on the patio area only between the hours of 11:00 a.m. and 12:00 a.m., each day of the week.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

The petitioner(s) shall post a prominent, permanent sign stating, “NO LOITERING IS ALLOWED ON OR IN FRONT OF THESE PREMISES” in a place that is clearly visible to patrons of the licensed premises. The sign shall be at least two feet square with at least two inch block lettering.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The sale of alcoholic beverages for off-site consumption shall only be made to patrons who purchase meals as defined in Section 23038 of the Business and Professions Code.

The use of any amplifying system or device is prohibited on patio, and the use of any such system or device inside the premises shall not be audible outside the premises.

Sales and service of alcoholic beverages on said patio shall be restricted to waiter/waitress service and only to patrons seated at a table.

When the said patio of the premises is being utilized for the sales, service, and consumption of alcoholic beverages, a premises employee shall be in attendance and maintain continuous supervision at all times of said area.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

Between the hours of 11:00 a.m. - 2:00 a.m. or at any time the premises are providing Karaoke, the petitioner(s) shall provide two uniformed security guard(s) in the parking lot and/or premises and shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of their property by nearby residents or the surrounding community. The licensed uniform security guard must be licensed by the State of California, Department of Consumer Affairs.

With the exception of restrooms, all patron areas of the licensed premises must be visible to the licensee(s), premises employee(s), and other patrons at all times.

No employee or agent shall be permitted to accept money or any other thing of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee(s) provide or permit, or make available either gratuitously or for compensation, male or female persons who act as escorts, companions, or guests of and for the customers.

Karaoke Studio Rooms constructed on the premises shall have the following characteristics: a. A viewing window in the door or wall that provides a clear and unobstructed view of the interior of the room. b. All doors to said Karaoke studio rooms will remain unlocked at all times while the room is in use. c. The “Studio Rooms” shall be equipped with audio and video equipment sufficient for performances commonly associated with “karaoke” style entertainment at all times while the room is in use. d. No locking hardware of any kind shall be installed on any door to a karaoke room. Doors shall remain unlocked and unobstructed at all times. Door locks, locking chains, deadbolts, door stops, or similar devices are prohibited. e. All glass panes into karaoke rooms, including glass panes in doors, shall remain unobstructed at all times. f. The lighting in karaoke rooms shall not be equipped with dimmers. g. Each karaoke room shall be monitored through a camera surveillance system. Recordings shall be maintained for a minimum period of 30 days and are intended for use by the Department of Alcoholic Beverage Control.
