Operating Restrictions:

Sales, service or consumption of alcoholic beverages shall be permitted only between the hours of 10:00 a.m. to 11:00 p.m. Sunday through Thursday and 10:00 a.m. to 12:00 Midnight Friday and Saturday.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 24 hours of being applied.

There shall be no bar or lounge area upon the licensed premises maintained for the purpose of sales, service or consumption of alcoholic beverages directly to patrons for consumption.

There shall be no coin operated games or video machines maintained upon the premises at any time.

No pool or billiard tables may be maintained on the premises.

No "happy hour" type or reduced price alcoholic beverage promotion shall be allowed.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 9/22/15 and ABC-253 dated 9/22/15.

Trash pickup at the premises will be made no earlier than 8:00 AM to 6:00 PM Monday through Friday; and 9:00 a.m. to 5:00 p.m., Saturday and Sunday.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

At all times when the premises are open for business the sale of alcoholic beverages shall be made only in conjunction with the sale of food to the person ordering the beverage.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

Sales, service and consumption of alcoholic beverages is confined to the ground floor level only, and outdoor service is prohibited.

Applicant shall provide 12 off street parking spaces in the lot behind the premises. Applicant shall secure and maintain and additional five off site parking spaces for use during the hours of 6:00 p.m. until closing, seven days a week.

There shall be no valet parking on the residential streets.

Applicant shall provide valet service between the hours of 6:00 p.m. and one half hour after closing seven days a week. During these hours parking shall be valet service only.

Live entertainment shall be limited to 3 performers, including a poetry reader. The use of drums is prohibited. Live entertainment shall not include karaoke, topless dancing, nude dancing, or male dancers.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 9/22/15 and ABC-253 dated 9/22/15.

Live entertainment will be permitted only between the hours of 10:00 a.m. to 10:30 p.m., Sunday through Thursday and 10:00 a.m. to 11:30 p.m., on Friday and Saturday.

The doors of the restaurant shall be kept closed at all times that the restaurant is open for business, except in the case of emergencies, deliveries and the passage of patrons entering or exiting the facility.

The licensee shall serve full and complete meals in compliance with Section 23038 of the Business and Professions Code until 10:00 p.m., Sunday through Thursday and 11:00 p.m. Friday and Saturday.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.
