The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Full and complete meals must be offered and made available at all times the premises is exercising the privileges of its alcoholic beverage license, with the exception of the last two (2) hours of operation each day.

Sales, service and consumption of alcoholic beverages shall be permitted in or on the patio area only between the hours of 9:00 a.m. to 10:00 p.m., Sunday through Thursday and 9:00 a.m. to 11:00 p.m., Friday and Saturday.

There shall be no live entertainment of any type, including but not limited to, live music, disc jockey, karaoke, topless entertainment, male or female performers or fashion shows.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

The use of any amplifying system or device is prohibited on patio area, and the use of any such system or device inside the premises shall not be audible outside the premises.

No employee or agent shall be permitted to accept money or any other thing of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee(s) provide or permit, or make available either gratuitously or for compensation, male or female persons who act as escorts, companions, or guests of and for the customers.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

When the said patio area of the premises, as depicted on the most recently certified ABC-257 is being utilized for sales, service and consumption of alcoholic beverages, it shall be equipped with video camera(s) so staff members may continually monitor the said area.

The smoking of tobacco products shall not be allowed within the area under the control of the licensee, as depicted on the most recently certified ABC-257.
