Operating Restrictions:

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Sales, service and consumption of alcoholic beverages shall be permitted in the outdoor patio area located to the rear (backyard) of the premises structure, only between the hours of 10:30 a.m. and 11:00 p.m., each day of the week.

No alcoholic beverage shall be consumed on any property adjacent to the licensed premises, except the licensed patio(s), under the control of the licensees.

The boundaries of the patio(s) will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

The licensee(s) will erect and maintain signs at all entrances/exits of the patio(s) prohibiting the removal of open alcoholic beverage containers.

Sales, service and consumption of alcoholic beverages shall be permitted on the patio(s) located at the front of the premises, adjacent to the public sidewalk only between the hours of 10:30 a.m. and 11:00 p.m., each day of the week.

The licensee(s) or an employee of the licensee(s) will monitor the patio(s) at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance with all applicable laws and/or conditions.

Petitioner(s) shall police the area under their control in an effort to prevent the loitering of persons about the premises.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s).
