Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 am and 2:00 am each day of the week.

Private/semi-private (Karaoke) Rooms constructed on the premises shall have the following characteristics: a. No physical obstruction, including but not limited to planters, partitions or items of décor, shall be placed or attached, fastened or connected in any manner to any section the wall or ceiling which would obstruct the view of any portion of the interior of the room. b. No physical obstruction, including but not limited to planters, partitions of items of décor, shall be placed or attached to any section of the door or walls which covers any portion of the glass within the door or walls. c. All doors and walls to said room shall be constructed in such a manner as to have at least a clear glass window in the upper portion of said door and walls which measures no less than 22x22 inches. d. All doors to said rooms will remain unlocked and shall not have any form of locking mechanism attached to or near the door. e. The lighting in said rooms will be sufficient to make easily discernible the activities in the interior of the rooms at all times. f. There shall be no “dimmer” type lighting controls in the interior of said rooms. g. Said rooms shall not contain refrigeration units of any type h. All food and beverages served to patrons utilizing said rooms will be by way of waitress service only. i. Said rooms shall be equipped with audio and video equipment sufficient for performance commonly associated with “Karaoke” style entertainment. j. Karaoke style entertainment must be available at all times in said rooms during the hours of operation of the premises. k. No obstructions other than clear glass, shall be attached fastened or connected to either the partitions or ceiling to separate the booths/dining areas within the interior space of the licensed premises. l. Said obstructions, partitions other than clear glass shall not exceed 54” in height.

The petitioner shall employ at least two state licensed uniformed security guards from 6:00pm to 2:30am each day of the week. At least one security guard shall be posted in the premises parking lot.

Distilled Spirits shall be sold by the individual drink only, sale of distilled spirits by the bottle is prohibited.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

The sale of alcoholic beverages for consumption off the premises is prohibited.

The door(s) shall be kept closed at all times during the operation of the premises except in cases of emergency and to permit deliveries. Said door(s) not to consist solely of a screen or ventilated security door.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC 257 dated 12/17/2021 and ABC 253 dated 12/17/2021.

There shall be no live entertainment or dancing permitted on the premises at any time. This condition shall not prohibit Karaoke, or one piano/organist.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

No pool tables or amusement machines may be maintained on the premises.

No employee or agent shall be permitted to accept money or any other thing of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee(s) provide or permit, or make available either gratuitously or for compensation, male or female persons who act as escorts, companions, or guests of and for the customers.

No employee or agent shall solicit or accept any alcoholic or non-alcoholic beverage from any customer while in the premises.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Customers and the general public must be informed that the primary business of the establishment is the sale of food which shall include but not be limited to, providing, each customer with a menu, posting signs on the premise and advertising the food service.

Food service, with an available menu, shall be available until one (1) hour prior to closing time on each day of operation.

The premises shall be furnished with tables and chairs at which food may be comfortably consumed and with all cutlery, condiments and linen with which an eating establishment is customarily equipped.

The licensee shall be responsible for keeping the area adjacent to the premises over which the licensee has control and the off-street parking area free of litter.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC 257 dated 12/17/2021 and ABC 253 dated 12/17/2021.

At no time shall there be minimum drink requirement.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

There shall be no bar or lounge area upon the licensed premises maintained for the purpose of sales, service or consumption of alcoholic beverages directly to patrons for consumption.

The license may not be surrendered for private parties or one day licenses.

Petitioner(s) shall make no changes in the premises interior without prior written approval from the Department.

At no time shall there be a cover charge for admittance to the premises.
