Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Sales, service and consumption of alcoholic beverages shall be permitted in or on the patio area only between the hours of 11:30 a.m. and 10:30 p.m., Tuesday through Thursday, 11:30 a.m. and 12:00 a.m., Friday and Saturday.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as depicted on the most recently certified ABC-257.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The use of any amplifying system or device is prohibited on patio area, and the use of any such system or device inside the premises shall not be audible outside the premises.

When the said patio area of the premises is being utilized for the sales, service, and consumption of alcoholic beverages, a premises employee shall be in attendance and maintain continuous supervision at all times of said area.

With the exception of restrooms and patio area, all patron areas of the licensed premises must be visible to the licensee(s), premises employee(s), and other patrons at all times.
