The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Peace officers, as listed in Section 830.1 of the California Penal Code, and the Director and other persons employed by the Department of Alcoholic Beverage Control for the administration and enforcement of the Alcoholic Beverage Control Act are hereby authorized to visit and inspect the proposed premises as outlined in red on the most recently certified ABC-257, at any time the undersigned is exercising the privileges authorized by the license on such premises.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257.

When the said interior terrace, Space M52 of the premises is being utilized for the sales, service, and consumption of alcoholic beverages, a premises employee shall be in attendance and maintain continuous supervision at all times of said area.

A sign shall be posted in a conspicuous space at the entrance/exit point of the licensed areas, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

With the exception of restrooms, all patron areas of the licensed premises must be visible to the licensee(s), premises employee(s), and other patrons at all times.

No patron will be permitted to carry an alcoholic beverage from interior portion of Space M64 to terrace, Space M52, nor from said terrace, Space M52 to the interior portion of Space M64.

At all times when the premises is exercising the privileges of their license, the sale of food, in compliance with Section 23038 of the Business and Professions Code, shall be offered and available for purchase in both Spaces M52 and M64. No more than two (2) alcoholic beverages shall be sold or served to any one (1) person during any transaction. Alcoholic beverages shall be served in containers which significantly differ in appearance from those containers utilized for non-alcoholic beverages. Containers for beer shall not exceed 16 ounces.

No patron shall be sold or allowed to possess a sealed container of alcoholic beverages. All alcoholic beverage containers shall be opened by premises employee(s) prior to the sale.
