Operating Restrictions:
The sale of alcoholic beverages for consumption off the premises is strictly prohibited.
The premises shall be maintained as a bona fide restaurant and shall make the food menu available at all times the premises is open for business.
The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.
Food facilities must be maintained in a sanitary condition and the premises must be equipped with a proper amount of refrigeration for keeping of food on the premises and be equipped with such other facilities as are necessary to comply with all regulations of the local health department.
The premises shall be equipped and maintained in good faith and shall possess in operative condition such convenience for cooking foods as stoves, ovens broilers or other devices, as well as pots, pans or containers which can be used for cooking or heating foods on the type of heating device employed.
Entertainment provided shall not be audible beyond the area under the control of the licensee.
The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises under the control of the licensee(s).
The exterior of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.
At any time the premises are providing live entertainment and/or dancing, the licensee(s) shall provide a uniformed security guard, licensed by the California State Department of Consumer Affairs. The security guard shall be responsible for maintaining order therein and prevent any activity which would interfere with the quiet enjoyment of the property of nearby residents.
The subject alcoholic beverage license shall not be exchanged for a public premises type license.
No alcoholic beverages shall be consumed on any property adjacent to the licensed premises, except the licensed patio(s), under the control of the licensee(s).
The boundaries of the patio(s) will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.
The licensee(s) or an employee of the licensee(s) will monitor the patio(s) at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance with all applicable laws and/or conditions.
The licensee(s) will erect and maintain signs at all entrances/exits of the patio(s) prohibiting the removal of open alcoholic beverage containers.
Sales, service and consumption of alcoholic beverages on the back patio area shall be permitted only between the hours of 8 a.m. to 10 p.m. daily.
