Operating Restrictions:

Sales and delivery of alcoholic beverages shall be permitted only between the hours of 10:00 a.m. and 10:00 p.m., daily.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

When the premises is closed for business the parking lot will be secured by a clearly defined and designated physical barrier in order to prevent loitering in said parking area.

The licensee shall be responsible for keeping the area adjacent to the premises over which the licensee has control and any off-street parking area free of litter.

There shall be no coin-operated amusement devices maintained upon the premises at any time.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

No wine or distilled spirits, with the exception of win coolers, shall be sold in containers of less than 750 ml. No miniatures or any type may be sold. Wine coolers shall not be sold in less that four-pack quantities.

No beer or malt beverages in containers under one (1) quart shall be sold in less than six-pack quantities.

Ice shall be sold at or above prevailing prices in the area and in quantities of not less that five (5) pounds per sale.

Licensee shall keep the property adjacent to the licensed premises and under the control of the licensee, clear of newspaper racks, benches, pay telephones, bicycle racks or other objects which encourage loitering.

Trash pack-up at the premises will be made no earlier than 7:00 a.m. nor later than 7:00 p.m.

The petitioner shall stock and offer for sale a substantial assortment of gourmet foods, as indicated in his application to the Zoning Administrator for his Conditional Use Permit.

The licensee(s) shall not sell and/or offer for sale or display any magazine, video or other printed material which contains pictures depicting: a. Acts or simulated acts of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any sexual acts which are prohibited by law. b. Any person being touched, caressed or fondled on the breast, buttocks anus or genitals. c. Scenes wherein a person displays the vulva or the anus or the genitals. d. Scenes wherein artificial devices or inanimate objects are employed to depict, or drawings are employed to portray, any other prohibited activities described above.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

A parking attendant/security guard shall be available in the parking lot from 5:00 p.m. until one-half hour after closing.
