Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11 a.m. and 1:45 a.m. each day of the week.

During normal hours of restaurant operation petitioner(s)shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks. An admission charge or a cover charge may be permitted for occasional, special events including but not limited to magic shows and live performances. The intent of these conditions is to provide flexibility in the operation of the Pig N Whistle Restaurant but in no way sanctions or approves a change of use from restaurant to a nightclub without the further appropriate review by the City of Los Angeles Planning Department and the Department of Building and Safety.

The sale of alcoholic beverages for consumption off the premises is prohibited.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

This alcoholic beverage license shall not be exchanged for a public premises type license. The business shall not be operate as a public premises.

No “Happy Hour” type of reduced price alcoholic beverage promotion shall be allowed.

The fixed bar maintained on the premises shall have food service available at all times.

The premises shall be maintained as a bona fide eating place in compliance with Business and Professions Code Sec. 23038 (restaurant) with an operational kitchen, and shall provide a menu containing foods normally offered in such restaurants. Food service shall be available during operational hours.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

Only one (1) pay phone shall be permitted. Said pay phone shall be maintained inside the premises under the control of the licensee(s).

There shall be no pool, billiard or table games of any kind allowed in or on the premises at any time.

There shall be no amusement machines or video game devices in or on the premises at any time.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 24 hours of being applied.

Trash pickup at the premises will be made no earlier than 8:00 a.m. nor later than 7:00 p.m.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

Between the hours of 9:00 p.m. and 1/2 hour past closing the petitioner(s) shall provide a minimum of one (1) licensed uniformed security guard(s). The licensed uniformed security guard(s) shall patrol the interior of the premises and act as roving patrol along the parking lot and exterior of the premises. The licensed uniformed guard(s) shall maintain order therein.

The licensee(s) or an employee of the licensee(s) will be present in or on the patio area(s) at all times that alcoholic beverages are being served or consumed.
