Operating Restrictions:

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

The petitioner(s) shall post a prominent, permanent sign stating, “NO LOITERING IS ALLOWED ON OR IN FRONT OF THESE PREMISES” in a place that is clearly visible to patrons of the licensed premises. The sign shall be at least two feet square with at least two inch block lettering.

Petitioner shall not permit any person to possess an open container or consume alcoholic beverages in or around the licensed premises as depicted on the most recently certified ABC-257 and ABC-253.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The petitioner shall at all times maintain records which separately reflect the gross sales of alcoholic beverages and the gross sales of all other products sold at the licensed premises. Said records shall be made available lo the Department upon demand by the Department.

WHEREAS, to be eligible for an instructional tasting license at an off-sale premises with a total of less than 5.000 square feet of interior retail space, calendar quarterly sales of alcoholic beverages must comprise at least 75 percent of the total gross sales of all products sold at the premises; and,
