Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Full and complete meals must be offered and made available at all times the premises is exercising the privileges of its alcoholic beverage license, with the exception of the last one (1) hour of operation each day.

Sales, service and consumption of alcoholic beverages shall be permitted in or on the patio areas only between the hours of 9:00 a.m. to 10:00 p.m., Sunday through Thursday, 9:00 a.m. to 11:00 p.m., Friday and Saturday.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

The use of any amplifying system or device is prohibited on patio areas, and the use of any such system or device inside the premises shall not be audible outside the premises.

When the patio areas and dining room areas of the premises, as depicted on the most recently certified ABC-257 is being utilized for sales, service and consumption of alcoholic beverages, they shall be equipped with a video camera(s) so staff members may continually monitor said patio areas and dining room areas.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio areas, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

When the said patio area is being utilized for the sales, service, and consumption of alcoholic beverages, the railing shall be in place at the boundary location approved on the most recently certified ABC 257.
