Operating Restrictions:

The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledges that incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

During normal meal hours, the premises shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control

Petitioner(s)shall not allow their patrons or the general public to loiter or congregate on the sidewalks or any property adjacent to their licensed premises.

No noise shall be audible beyond the area under the control of the licensee(s).

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 6:00 a.m. to 10:00 p.m. Sunday through Thursday and 6:00 a.m. to 12:00 midnight Friday and Saturday.

The sale of alcoholic beverages for consumption off the premises is prohibited.

Licensee(s) shall post and maintain on the premises, and in the parking lot used in conjunction therewith, notices or signs, no less than eighteen inches by twenty-four inches ("18x24") in size, clearly visible to patrons of the licensee(s) and parking lot and to persons on the public sidewalk stating in two (2) inch block lettering the following: NO LOITERING IS ALLOWED ON OR IN FRONT OF THE THESE PREMISES
