Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 a.m. and 12:00 midnight each day of the week.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The use of any amplifying system or device is prohibited on the patio area, and the use of any such system or device inside the premises shall not be audible outside the premises.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 48 hours of being applied.

Alcoholic beverages shall be sold and served in containers that are distinctive in design and color and are easily distinguishable from containers used in the service of non-alcoholic beverages for all special events.

No “Happy Hour” type of reduced price alcoholic beverage promotion shall be allowed.

No Distilled Spirits shall be sold by the bottle.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

The sale of alcoholic beverages for consumption off the premises is prohibited.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Except in the designated restaurant patio area as depicted on the most recently certified ABC-257 no more than two (2) containers of alcoholic beverages shall be sold to a patron during any special event transaction.

Peace officers, as listed in Section 830.1 of the California Penal Code, and the Director and other persons employed by the Department of Alcoholic Beverage Control for the administration and enforcement of the Alcoholic Beverage Control Act are hereby authorized to visit and inspect the proposed premises as outlined in red on the most recently certified ABC-257, at any time the undersigned is exercising the privileges authorized by the license on such premises.

The petitioner shall provide the Department with (Twelve) (#12) tickets, passes, or other means of entry to the premises for all events. Said documents shall allow access to all areas where alcoholic beverages are sold, served or consumed, shall not identify the bearer as a representative of the Department or as a law enforcement official, and shall be provided to the Department at least one week prior to each event held at the premises.
