The petitioner(s) shall construct and maintain a solid 6' wood fence along the rear of the premises and along east property line, extending west along the front of the patio area.

The boundaries of this patio will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent to the private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

The licensee(s) or an employee of the licensee(s) will be present in the patio at all times that alcoholic beverages are being served or consumed, to ensure that Alcoholic Beverage Control Act, State Statute, County or City Ordinances are not violated upon this portion of the licensed premises.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s).

Entertainment provided in the patio area shall be permitted no later than 11:00 p.m. each day of the week.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

The hours of operation in the patio area shall be permitted no later than 11:00 p.m. each day of the week.
