Operating Restrictions:
The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledges that incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.
During normal meal hours the premises shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.
The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.
The licensee(s) or an employee of the licensee(s) will monitor the patio(s) at all the times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance with all applicable laws and/or conditions
The boundaries of the patio(s) will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.
The licensee(s) will erect and maintain signs at all entrances/exits of the patio(s) prohibiting the removal of open alcoholic beverage containers.
No alcoholic beverage shall be consumed on any property adjacent to the licensed premises, except the licensed patio(s), under the control of the licensee(s).
Petitioner(s) shall not allow their patrons or the general public to loiter or congregate on the sidewalks or any property adjacent to their licensed premises.
The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.
No noise shall be audible beyond the area under the control of the licensee(s).
