Operating Restrictions:
Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 6:00pm to 2:00am each day of the week.
There shall be no bar or lounge area upon the licensed premises maintained for the purpose of sales, service or consumption of alcoholic beverages directly to patrons for consumption.
The premises shall be maintained as a bona fide food restaurant and shall provide a menu containing an assortment of foods normally offered in such restaurants.
The petitioner(s) shall stock and offer for sale a substantial assortment of food and/or merchandise commonly associated with and sold to persons in the community of extraction.
The premises shall possess the necessary utensils, table, service, and condiment dispenser with which to serve meals to the public.
The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledge that incidental, sporadic or infrequent sales of meals or a mere without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.
The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.
No pool or billiard tables may be maintained on the premises.
There shall be no more amusement machines or video game device(s) in the premises at any time.
Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 and ABC-253 dated January 23, 2020.
Entertainment provided shall be limited to Karaoke.
The sale of alcoholic beverages for consumption off the premises is strictly prohibited.
The boundaries of this patio will be clearly defined and designed by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not changed without prior approval of the Department of Alcoholic Beverage Control
In the patio area, the sale, service and consumption of alcoholic beverages shall be made to patrons which seated at their tables and in conjunction with food served to these same patrons.
There shall be no use of any amplifying system or device in the patio area.
No employee or agent shall be permitted to accept money or any other thing of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee(s) provide or permit, or make available either gratuitous or for compensation, male or female persons who act as escorts, companions, or guests of and for the customers.
Private/semi-private Karaoke rooms constructed on the premises and depicted on ABC-257 diagram dated January 23, 2020 shall have the following characteristics: a. No physical obstruction, including but no limited to planters, partitions or items of décor, shall be placed or attached to any section of the doors, wall or ceiling at the alcove openings. b. Doors to said rooms must allow the activities in the interior of the rooms to be easily discernible at all times. c. Doors to said rooms shall not be lockable from either side of the door. d. The lighting in said rooms shall be no "dimmer" type lighting controls in the interior of said rooms. e. All lighting in said rooms shall be controlled by one on/off switch. f. The lighting in said rooms shall be sufficient to illuminate and make easy discernible the interior of said rooms. g. Said rooms' lighting fixtures shall contain a minimum of three (3) white light bulbs. The wattage of each white light bulbs shall not be less than 75 watts. h. All food and beverages served to patrons utilizing said rooms will be by way of waiter/waitress service only. I. Said rooms shall be equipped with audio and video equipment sufficient for performances commonly associated with Karaoke style entertainment. j. Karaoke style entertainment must be available at all times in said rooms during the hours of operation of the premises. k. All windows between the rooms and in the doors shall be of clear glass and have the measurements as depicted on ABC-257 diagram dated January 23, 2020. l. Said rooms shall not contain refrigeration units of any type.
Petitioner(s) shall provide two state licensed uniformed security guard(s) between the hours of 6:00pm to one half hour after closing. At least on security guard shall be stationed in the rear parking lot.
