Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 7:00 a.m. and 12:00 midnight Sunday through Saturday.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 10-17-19.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The side door(s) shall be kept closed at all times during the operation of the premises except in cases of emergency and to permit deliveries. Said door(s) not to consist solely of a screen or ventilated security door.

There shall be no pool tables or coin-operated machines maintained upon the premises at any time.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

Consumption of alcoholic beverages in said patio area shall be permitted in the patio area only between the hours of 7:00 a.m. and 10:00 p.m. each day of the week.

Sales and service of alcoholic beverages on said patio area shall be restricted to waiter/waitress service and only to patrons seated at a table.

When the said patio area of the premises is being utilized for the sales, service, and consumption of alcoholic beverages, a premises employee shall be in attendance and maintain continuous supervision at all times of said area.

Said patio/terrace/other area shall be fully enclosed with a fixed barrier and shall have only one (1) entrance/exit point.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio/terrace/other area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

No patron will be permitted to carry an alcoholic beverage from interior portion of the premises to said patio/terrace/other area, nor from said patio/terrace/other area to the interior portion of the premises.

There shall be no entertainment permitted on said patio area at any time.

The petitioner (s) shall be responsible for all violations of law which may occur within the interior portion of the premises, in said patio area, and in the public walkway which separates the interior portion of the premises from said patio area.
