The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 8:00 a.m. to 10:00 p.m. each day of the week.

Sales, service and consumption of alcoholic beverages shall be permitted in or on the patio area only between the hours of 8:00 a.m. to 9:00 p.m., each day of the week.

The sale of alcoholic beverages for consumption off the premises is prohibited.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as depicted on the most recently certified ABC-257.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Said patio/terrace/other area shall be fully enclosed with a fixed barrier.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio/terrace/other area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.
