Operating Restrictions:

Entertainment and dancing shall only be inside the licensed premises building, as depicted on the ABC-257, Diagram of Licensed Premises date 7/18/19. No entertainment or dancing shall be permitted in the outdoor patio area of the licensed premises.

All doors of the licensed premises shall remain closed after 9:00 PM, with the exception of the doors facing Fourth Avenue and the normal ingress/egress by patrons of the business and licensee’s staff.

All patrons of the licensed premises shall enter the business from the door facing Fourth Avenue and all patrons of the licensed premises must exit the licensed premises from the doors facing Fourth Avenue after 11:00 PM, as depicted on the ABC-257, Diagram of licensed premises dated 7/18/19.

Sales, service and consumption of alcoholic beverages in the outdoor patio dining area shall be permitted only between 8:00AM and 12:00 Midnight.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited. A patron may remove partially consumed bottle of wine from the premises per Section 23396.5 of the Business and Professions Code.

The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period unless quarterly sales of food exceed $75,000 during said period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Music, public address systems, or speakers shall not be permitted in the outdoor patio dining area of the premises, as depicted on the ABC-257, Diagram of licensed premises dated 7/18/19.

No sounds, including but not limited to loud speakers, sound systems or other types of music or noise from the operation of the licensed premises shall be audible beyond the boundaries of the licensed premises building.

There shall be no pool tables, billiard tables, foosball games, or other amusement devices, coin operated or otherwise, permitted in the licensed premises.

Consumption of alcoholic beverages and/or loitering on any property adjacent to the licensed premises is Prohibited, as depicted on the ABC-257, Diagram of licensed premises dated 7/18/19.

On days when there is live entertainment and /or dancing in the licensed premises, the licensee shall employ three persons wearing clothing identifying themselves as security personal from 9:00 PM until one-half hour after the live entertainment or dancing ceases, whose primary duty shall be to patrol the interior of the licensed premises in order to alleviate the police problems, excessive noise, abusive behavior, and any other violations of law on or about the licensed premises.
