Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 a.m. and 12:00 Midnight Sunday through Wednesday and 10:00 a.m. to 1:30 a.m. thursday through Saturday.

No noise shall be audible beyond the area under control of the licensee.

Petitioners shall not permit their patrons or the general public to loiter or congregate on the sidewalks adjacent to the licensed premises.

The petitioners shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

The licensee shall comply with Section 23038 of the Business and Professions code and acknowledges that incidental, sporadic, or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.

During normal meal hours the premises shall be designed and used for and must possess the necessary utensils, table service and condiment dispensers with which to serve meals to the public.

The monthly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sales of food and gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a monthly basis and shall be made available to the Department on demand.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The subject alcoholic beverage license shall not be exchanged for a public type license nor operate as a public premises.

No pay telephone shall be maintained on the exterior of the premises.

The interior lighting maintained therein shall be sufficient to make easily discernable the appearance and conduct of all persons and patrons in that portion of the premises where alcoholic beverages are sold, served, delivered and consumed.

There shall be no coin-operated amusement devices that would constitute gambling, or represent and/or simulate any game of change.

At any time the premises is providing live entertainment, the petitioner shall provide security personnel that shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of the property by nearby residents. Said personnel shall be clothes in such a manner as to be readily identifiable as security.
