Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Sales, service and consumption of alcoholic beverages shall be permitted in or on the patio areas only between the hours of 6:00am to 11:00pm Sunday through Thursday and 6:00am to 1:00am Friday and Saturday.

No “Happy Hour” type of reduced price alcoholic beverage promotion shall be allowed.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Petitioner(s) shall actively monitor the area under their control in an effort to prevent the loitering of persons on any property adjacent to the licensed premises as depicted on the most recently certified ABC-253.

Sales and service of alcoholic beverages on said patio areas shall be restricted to waiter/waitress service and only to patrons seated at a table.

The use of any amplifying system or device is prohibited on patio areas, and the use of any such system or device inside the premises shall not be audible outside the premises.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio areas, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

The petitioner(s) shall post a prominent, permanent sign stating, “NO LOITERING IS ALLOWED ON OR IN FRONT OF THESE PREMISES” in a place that is clearly visible to patrons of the licensed premises. The sign shall be at least two feet square with at least two inch block lettering.
