Operating Restrictions:

Sales, service and consumption of alcoholic beverages inside the premises and in said patio areas shall be permitted only between the hours of 9 AM and 11 PM Sunday through Thursday and 9 AM to 12 AM (midnight) Friday through Saturday.

The use of any amplifying system or device is prohibited on the patio, and the use of any such system or device inside the premises shall not be audible outside the premises.

The patio areas shall be visible from within the licensed premises

Said patios shall be fully enclosed with a fixed barrier and shall have only one (1) entrance/exit point.

A sign shall be posted in a conspicuous space at the entrance/exit point of each said patio, which state, "NO ALCOHOLIC BEVERAGES BEYOND THIS POINT." Said signs shall measure no less than seven inches by eleven inches (7" x 11"), and contain lettering no less than one (1) inch in height.

Sales and service of alcoholic beverages on said patio areas shall be restricted to waiter/waitress service and only to patrons seated at a table.

Sales, service, and consumption of alcoholic beverages on said patios shall be limited to single serving glass containers not to exceed twelve (12) ounces in size. No bottles, pitchers or plastic cups will be permitted on said patio areas for the sales, services, or consumption of alcoholic beverages.

The monthly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee(s) shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledge(s) that incidental, sporadic, or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.
