Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall only be permitted in the designated deli/restaurant and wine/beer tasting areas as depicted on the ABC-257 dated 06-05-18.

The boundaries and entrances/exits of the designated deli/restaurant and wine/beer tasting areas shall not be changed without first notifying and securing the approval of the Department.

Applicant shall post a sign on the interior of, and adjacent to the exit of the wine/beer tasting area and the deli/restaurant as depicted on the ABC-257 dated 06-05-18, stating: "NO OPEN CONTAINERS OF ALCOHOLIC BEVERAGES MAY BE TAKEN BEYOND THIS POINT". The said posted sign shall be no less than 7" X 11" in size, and the lettering shall be in capital block letters no less than 1" in height with contrasting colors.

Sales, service and consumption of alcoholic beverages in the designated deli/restaurant area shall be shall be restricted to waiter/waitress and/or dispensed from the fixed bar within the designated deli/restaurant area as depicted on the ABC-257 dated 06-05-18.

Railing, stanchions, supporting ropes, counters, or similar type devices will be maintained which will physically separate and define the deli/restaurant area and the wine/beer tasting area. Entry ways into these licensed premises shall be no wider than 48 inches.

No alcoholic beverages shall be furnished to any person within the designated wine/beer tasting area without the cost of such beverages either paid for directly or incorporated within the cost of participating in a wine/beer appreciation course or tasting.

Individual servings of alcoholic beverages within the designated wine/beer tasting area shall not exceed two (2) ounces per glass or container. This condition shall not be construed so as to prohibit a patron from purchasing more than one (1) glass and/or container of an alcoholic beverage for the purpose of comparative tasting(s).

Sales, service, and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 a.m. and 10:00 p.m., Sunday through Thursday, and 10:00 a.m. and 12:00 midnight, Friday and Saturday.

No open containers containing alcoholic beverages shall be removed from the licensed premises for consumption at another location.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 06-05-18 and ABC-253 dated 06-05-18.

No beer or malt beverage products shall be sold for off-site consumption, regardless of container size, in quantities of less than six per sale.

There shall be no coin operated games or video machines maintained upon the premises at any time.

There shall be no amplified music on the premises at any time.

There shall be no live entertainment of any type, including but not limited to disc jockey, karaoke, topless entertainment, male or female performers or fashion shows, with the following exception: Live entertainment shall be limited to no more than three (3) non-amplified singers/musicians.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition. A single sign at the entrance of the premises identifying it as a wine/beer tasting area shall not be deemed a violation of this conditions. Said signs shall measure no more than 36" X 36".

Trash shall not be emptied into outside trash containers between the hours of 9:00 p.m. and 7:00 a.m. the following day.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 06-05-18 and ABC-253 dated 06-05-18.
