Operating Restrictions:

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 4/20/18 and ABC-253 dated 4/20/18.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 4/20/18 and ABC-253 dated 4/20/18.

Petitioner(s) shall police the area under their control in an effort to prevent the loitering of persons about the premises as depicted on ABC-253, dated 4/20/18.

The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and Acknowledges that incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.

During normal meal hours the premises shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee(s) will erect and maintain signs at all the entrance/exits of the patio(s) prohibiting the removal of alcoholic beverages.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises, except the licensed patio(s), under the control of the licensee(s).

The licensee(s) or an employee of the licensee(s) will monitor the patio(s) at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance with all applicable laws and/or conditions.

The boundaries of the patio(s) will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

The service of alcoholic beverages in the patio areas will only be made by the licensee(s) or an employee of the licensee(s). At no time shall a patron be allowed to carry alcoholic beverages from the licensed premises to the outdoor patio area(s).
