Operating Restrictions:

The use of any amplifying system or device is prohibited on the rooftop patio area, and the use of any such system or device inside the premises shall not be audible beyond fifty (50) feet from the exterior of the premises in any direction.

The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

At all times when the premises are open for business, food from the regular menu must be available to patrons up to one (1) hour before closing.

During normal meal hours, at least 50% of the premises seating shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.

No "happy hour" type of reduced price alcoholic beverage promotion shall be allowed, including no promotional drink specials or reduced drink specials.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

Petitioner(s) shall not share any profits, or pay any percentage or commission to a promoter or any other person, based upon monies collected as a door charge, cover charge, or any other form of admission charge, including minimum drink orders, or the sale of drinks.

A sign shall be posted at eye level and at all the entrance/exit points of said patio, as indicated on the attached ABC-257 dated 04-10-18 and ABC-253 dated 04-10-18, which shall state, "NO ALCOHOLIC BEVERAGES BEYOND THIS POINT". Said sign shall measure no less than seven inches (7" x 11"), and contain lettering no less than one (1) inch in height.

During all hours of entertainment, all exterior doors and windows shall be kept closed except to allow patron ingress/egress, to allow for deliveries and in the case of emergency.

There shall be no more than two (2) amusement machines or video game devices in the premises at any time.

There shall be no requirement to purchase a minimum number of drinks.
