Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 a.m. and 2:00 a.m. each day of the week.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

There shall be no amusement machines or video game devices in the premises at any time.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

Between the hours of 6:00 p.m. and 1 half hour after closing or at any time the premises are providing live entertainment including D.J.s, the petitioner(s) shall provide 1 licensed uniformed security guard(s) in the parking lot and shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of their property by nearby residents.

Petitioner(s) shall make no changes in the premises interior without prior written approval from the Department.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 and ABC-253.

There shall be no service of alcoholic beverage in the spa and massage areas.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

Private/semi-private (Karaoke) rooms (hereinafter "the rooms") constructed on the premises shall have the following characteristics: (a) All doors shall remain all clear glass with the exception of the frame. The windows shall also be of clear glass and be no smaller than 18" height x 36" width beginning no higher than 54" from the floor. No curtains, blinds, or drapes shall be placed or attached, fastened or connected in any manner to any section of wall or ceiling which obstructs the view of any portion of the interior of the room. (b) No physical obstruction, including but not limited to planters, partitions or items of décor, shall be placed or attached, fastened or connected in any manner to any section of the wall or ceiling which would obstruct the view of any portion of the interior of the room. (c) No physical obstruction, including but not limited to planters, partitions or items of décor, shall be placed or attached to any section of the door, walls or ceilings which covers any portion of the glass within the door or walls. (d) All doors to the rooms will remain unlocked and shall not have any form of locking mechanism attached to or near the doors. (e) The lighting in said rooms will be sufficient to make easily discernible the activities in the interior of the rooms at all times. (f) There shall be no "dimmer" type lighting controls in the interior of said rooms. (g) Said rooms shall not contain refrigeration units of any type. (h) All food and beverages served to patrons utilizing said rooms will be by way of waitress service only.

No employee or agent shall be permitted to accept money or any other thing of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee(s) provide, permit or make available either gratuitous or for compensation, male or female person(s) who act as escorts, companions or guests of and for the customers.

No employee or agent shall solicit or accept any alcoholic or non-alcoholic beverage from any customer while in the premises.
