Operating Restrictions:

The monthly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a monthly basis and shall be made available to the Department on demand.

Full meal service must be made available at all times the premises is open, operating and exercising the privileges of their Alcoholic Beverage Control license up to one-half (1/2) hour prior to the cessation of dispensing alocholic beverages or to closing.

The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledges that incidental, sporadic of infrequent sales of meals of mere offering of meals without actual sales shall not be sufficient to consider the premises in compliance with the aforementioned code section.

The sale of alcoholic beverages for consumption off the premises is prohibited.

Noise shall not be audible beyond the area under the control of the licensee(s) as depicted on the ABC-257 dated 7/31/2017.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

Petitioner shall regularly police the area under their control in an effort to prevent the loitering of persons about the premise.

The exterior of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the premises. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied. If the graffiti occurs on a Friday, a weekend day, or a holiday, the licensee(s) shall remove the graffiti within 72 hours following the beginning of the next weekday.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s).

The licensee(s) shall post and maintain signs at all entrances/exits of the patio(s) prohibiting the removal of open alcoholic beverage containers.

The licensee(s) or an employee of the licensee(s) will monitor the patio at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance with all applicable laws and/or conditions.
