Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 am and 12:00 Midnight each day of the week.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The premises shall be maintained as a bona fide food restaurant and shall provide a menu containing an assortment of foods normally offered in such restaurants. Food service shall be available at all times during normal operating hours.

The applicant shall furnish the premises with tables and/or booths at which food may be comfortably consumed and with all cutlery and condiments with which an eating establishment is customarily equipped.

The applicant shall inform customers and the general public that the primary business of the establishment is the sale of food, which shall include but not be limited to, providing each customer with a menu, posting signs on the premises and advertising the food service.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

No employee or agent shall solicit or accept any alcoholic or non-alcoholic beverage from any customer while in the premises.

No employee shall be engages for the specific purpose of sitting with or otherwise spending time with customers while in said premises.

No booths or group seating shall be installed with dividers or partitions between them that are more than 52' in height. No partitions, dividers or curtains shall be installed that restrict, limit or obstruct the clear observation of the occupants.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

Entertainment and amplified music provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 and ABC-253 dated 7/22/14.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

There shall be no dancing allowed on the premises.

There shall be no live entertainment of any type, including but not limited to live music, disc jockey, karaoke, topless entertainment, male or female performers or fashion shows.

Petitioner(s) shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks. Payment for food and beverage service shall be made only after such service has been provided to the patron inside the location.

No "happy hour" type or reduced price alcoholic beverage promotion shall be allowed.

The applicant shall not sublet the premises for nightclub activity.

The applicant shall not allow "promotional nights". Promotional nights, include, but are not limited to, time periods during which female patrons may purchase beverages at a discounted price, encouraging patrons to come to the premises for beverages after an entertainment event at another location, and selling certain brands and/or types of beverages at a discounted price to bring attention to these brands and/or beverages.

There shall be no requirement to purchase a minimum number of drinks.
