Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The subject alcoholic beverage license shall not be exchanged for a public premises type license.

The licensee or an employee of the licensee will monitor the patio area, at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance of all applicable laws and/or conditions.

The licensee shall erect and maintain signs, clearly visible to patrons of the licensee, at all entrances/exits of the patio area prohibiting the removal of open alcoholic beverage containers from the licensed premises.

The boundaries of the patio area will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensees. These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

Petitioners shall regularly police the area under their control in an effort to prevent the loitering of persons about the premises.
