Operating Restrictions:

The sale of distilled spirits by the bottle for same day or future consumption is prohibited.

Licensees not exercising the privileges of their license until after 5:30 p.m. are deemed not exercising the privileges of their license in good faith and said method of operation shall be deemed contrary to public welfare or morals and an attempt on the part of the licensee to circumvent the provisions of Section 23038 of the Business and Professions Code. Nothing herein shall prohibit licensee from being closed for business certain days of the week.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The hours of operation shall not exceed 2:00 a.m. daily.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 48 hours of being applied.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated (date) and ABC-253 dated (date).

Between the hours of TIME and TIME or at any time the premises are providing TYPE OF ENTERTAINMENT , the petitioner(s) shall provide NUMBER licensed uniformed security guard(s) in the parking lot and shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of their property by nearby residents.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated (date) and ABC-253 dated (date).

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated (date) and ABC-253 dated (date).

Petitioner(s) shall not share any profits, or pay any percentage or commission to a promoter or any other person, based upon monies collected as a door charge, cover charge, or any other form of admission charge, including minimum drink orders, or the sale of drinks.

Partitions separating the booths/dining areas shall not exceed 52" in height.

The licensee(s) shall not maintain or construct any type of enclosed room intended for use by patrons or customers for any purpose.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

No pool or billiard tables may be maintained on the premises.

There shall be no amusement machines or video game devices in the premises at any time.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

The premises shall not be maintained nor operated as a private club.

Admittance to the premises shall not be discriminatory so as to exclude persons because of a certain race, color, creed, religion, ancestry, disability or sex.

The petitioner(s) shall not sublet any portion of the licensed premises or activities within the licensed premises to any promoter.

the first floor level measuring 112' x 130' located in the eastern portion of the premises as depicted on the ABC-257 diagram dated 04/18/17, shall be used for office space and the storage of alcoholic beverages only. No sales, service or consumption of alcoholic beverages shall be permitted in this area. Licensee may apply at a later date for consent for the Department to modify this condition to utilize this space once a specific plan is determined for its use.

No person under 21 years of age shall be allowed to enter or remain on the first level dance/floor/stage area as depicted on the ABC-257 date 04/18/17, after 10:00 p.m., each day of the week.

Petitioner(s) shall make no changes in the premises interior without prior written approval from the Department.

Petitioner(s) shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks.

There shall be no topless entertainment whether with male or female performers.

Food service, with a menu, shall be available within premises at all times the premises is open and operating.

No "happy hour" type of reduced price alcoholic beverage promotion shall be allowed.

The premises must maintain interior public passageways connecting all areas within the licensed location.
