Operating Restrictions:

The petitioner shall serve full and complete meals in compliance with Section 23038 of the Business and Professions Code until 11:00 p.m., each day of the week.

The sale of alcoholic beverages for consumption off the premises is prohibited.

All door(s)shall be kept closed at all times during the operation of the premises except in cases of emergency to permit deliveries and to permit patrons to come and go.

The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The applicant shall at all times keep records which reflect separately the gross sales of alcoholic beverages and the gross sales of all other items. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

There shall be no dancing permitted or live entertainment of any type, including but not limited to live music, disc jockey, karaoke, topless entertainment, male or female performers or fashion shows.

Entertainment provided shall not be audible beyond the licensed premises.

Pool tables, and electronic amusement devices or games shall not be permitted on the licensed premises at any time.

Alcoholic beverages shall not be consumed on any property adjacent to the licensed premises which is under the control of the licensee.

At no time shall there be a minimum drink requirement.

At no time shall there be a fee for entrance/admittance in the premises.

There shall be no "Happy Hours" when drinks are offered at a reduced rate.

The petitioner shall provide a security guard or employee, attired in such a manner so as to clearly identify him or her as security, whose duties shall include monitoring the activities of the people waiting for entrance into, and exit out of, the premises, and otherwise maintaining order on property adjacent to the licensed premises which is under the control of the licensee. Said person shall be on-duty between the hours of 9:00 p.m. and 2:30 a.m. each day of the week.

Between the hours of 9:00 p.m. and closing, each day of the week, petitioner shall provide an employee, attired so as to identify him as a security guard, whose duties shall be to remain within seven (7) feet of the doorway identified on Exhibit # 1 appended hereto, to keep said door closed, and to prohibit its use as a means or ingress or egress to the licensed premises, except in case of emergency.
