Operating Restrictions:

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257.

Sales, service and consumption of alcoholic beverages shall only be permitted in the confined of the designated On-Sale Beer and Wine Eating Place premises (Type 41) located in the licensed area as depicted on the most recently certified ABC-257.

Petitioner(s) shall maintain a permanent barrier separating the On-Sale Beer & Wine Eating Place premises (Type 41) from the Off-Sale General premises license (Type 21). Said barrier shall be a minimum of four (4) feet in height.

The boundaries and any entrance to the On-Sale Beer & Wine Eating Place premises (Type 41) license from the Off-Sale General premises license (Type 21) shall not be exchanged without first notifying and securing the approval of the Department.

Signs shall be posted at all exits leading into the designated Off-Sale General premises license (Type 21) from the designated On-Sale Beer & Wine Eating Place premises license (Type 41) stating "NO OPEN CONTAINERS OF ALCOHOLIC BEVERAGES BEYOND THIS POINT".

The patio area of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons onor about the patio area. Additionally, the position of said lighting shall not disturb the normal privacy and use of any neighboring residences.

Sales, service and consumption of alcoholic beverages on the exterior patio area, which is defined by the most recently certified ABC-257, shall be permitted only between the hours of 8:00 am to 11:00 pm each day of the week.

The licensee(s) or an employee of the licensee(s) will be present in the back patio at all times that alcoholic beverages are being served or consumed.

There shall be no live entertainment of any type, including live music, disc jockey and or karaoke on the exterior patio area at any time.
