Operating Restrictions:

As to the premises outdoor patio area located to the rear of the premises, sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 a.m. and 12:00 midnight Sunday through Thursday and 10:00 a.m. to 1:00 a.m. the following Friday and Saturday.

When the premises outdoor patio area located to the rear of the premises is being utilized for the sales service and consumption of alcoholic beverages, a premises employee shall be in attendance and maintain continuous supervision at all times in said area.

As to the premises interior, live entertainment consisting of not more than four (4) performers shall be permitted between the hours of 2:00 p.m. and 1:00 a.m. each day of the week. The performers may use amplification equipment. Otherwise, live entertainment and dancing are prohibited.

As to the premises outdoor patio area located to the rear of the premises, live entertainment consisting of not more than four (4) performers shall be permitted between the hours of 2:00 p.m. and 10:00 p.m. on Fridays, Saturdays, Sundays and national holidays. The performers may use amplification equipment. Otherwise, live entertainment, amplified music and dancing are prohibited.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 01-31-18 and ABC-253 dated 01-31-18

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 01-31-18 and ABC-253 dated 01-31-18

No pool or billiard tables may be maintained on the premises at any time.

There shall be no more than two (2) coin-operated games maintained upon the premises at any time.

The rear patio fire exits shall not be utilized for patron ingress or egress and signs shall be conspicuously posted identifying these exits for emergency only.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

Sales and service of alcoholic beverages in said patio area shall be permitted only between the hours of 11:00 a.m. and 9:30 p.m. each day of the week.

Consumption of alcoholic beverages in said patio area shall be permitted only between the hours of 11:00 a.m. and 10:00 p.m. each day of the week.

Sales and service of alcoholic beverages on said patio area shall be restricted to waiter/waitress service and only to patrons seated at a table.

When the said patio area of the premises is being utilized for the sales, service and consumption of alcoholic beverages a premises employee shall be in attendance and maintain continuous supervision at all times of said area.

Said patio shall be fully enclosed with a fixed barrier and shall have only (1) entrance/exit point.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio which shall state, "NO ALCOHOLIC BEVERAGES BEYOND THIS POINT". Said sign shall measure no less than seven inches by eleven inches (7" X 11") and contain lettering no less than one (1) inch in height.

No patron will be permitted to carry an alcoholic beverage from the interior portion of the premises to said patio area, nor from said patio area to the interior portion of the premises.

Sales, service and consumption of alcoholic beverages on said patio area shall be limited to glass containers not exceeding twelve (12) ounces in size. No bottles or pitchers will be permitted on said patio area.

There shall be no entertainment permitted on said patio area at any time.

The petitioner(s) shall be responsible for all violations of law which may occur within the interior portion of the premises, in said patio area and in the public walkway which separates the interior portion of the premises from said patio area.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

Petitioner(s) shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks.

At all times when the premises are open for business food from the menu must be available to patrons up to 60 minutes before closing.
