Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 a.m. and 10:00 p.m. daily. All activities at the premises shall stop at the above stated times including private functions. There shall be no "after hours" use of the premises.

At times when the premises are open for business the sale of alcoholic beverages shall be incidental to the sale of food.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The premises shall be maintained as a bona fide restaurant and shall provide a menu containing an assortment of foods normally offered in such restaurants. Food service shall be available at all times during normal operating hours.

The licensee shall furnish the premises with tables and chairs at which food may be comfortably consumed and with all cutlery and condiments with which an eating establishment is customarily equipped.

The licensee shall inform customers and the general public that the primary business of the establishment is the sale of food which shall include but not be limited to providing each customer with a menu, posting signs on the premises, and advertising the food service.

The licensee shall open no later than 4:30 p.m. and be prepared to serve the food listed on the menu at all times that the premises is open.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

There shall be no coin operated video games maintained upon the premises at any time.

There shall be no pool, billiard or table games of any kind allowed in or on the premises at any time.

No employee or agent shall be permitted to accept money or any other thing of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee(s) provide or permit, or make available either gratuitous or for compensation, male or female persons who act as escorts, companions, or guests of and for the customers.

No booths or group seating shall be installed with dividers or partitions between them that are more than fifty-four (54) inches high. No partitions, dividers or curtains shall be installed that restrict, limit or obstruct the clear observation of the occupants.

No obstructions shall be attached, fastened or connected to either the partitions or ceiling to separate the booths/dining areas within the interior space of the licensed premises.

The sale of alcoholic beverages for consumption off the premises is prohibited.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

The petitioner(s) shall make no changes in the premises interior without prior written approval from the Department.

There shall be no live entertainment, dancing or amplified music permitted on the premises at any time.

The subject alcoholic beverage shall not be exchanged for a public premises type license nor operated as a public premises.

Petitioner(s) shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks.

No employee or agent shall solicit or accept any alcoholic or non-alcoholic beverage from any customer while in the premises.
