Online Beer Price Posting Requirements

ABC has spent the last several years developing a modernized online price posting program. Stakeholders have been able to aid, guide, and test the online digital price posting system to assist ABC in creating the best solution possible. The online price posting system went live on February 16, 2021, and was fully accessible to all licensees as of May 17, 2021. ABC issued its proposed regulatory package requiring all licensees to post their prices in the online system on October 26, 2022. During the intervening time, ABC has diligently worked with stakeholders to conform the price posting regulations to aid in the proliferation of an orderly beer market in California.

Many licensees are already using the online price posting system and ABC thanks them for their early adoption, participation, and aid in making the system better for all users. However, there are still some manufacturers, importers, and wholesalers who have not yet transitioned to the online price posting system and have continued to post prices using the previous paper submission process.

On September 5, 2023, ABC submitted the online beer price posting regulatory package to the Office of Administrative Law (OAL) for approval. OAL has thirty (30) business days to review the proposed regulation and determine its compliance with the standards of the Administrative Procedure Act. ABC has requested that these regulations become effective at the time they are approved by OAL and filed with the Secretary of State.

ABC will notify the industry further when the online beer price posting regulation becomes effective. At that time only prices posted within the online system will be effective. This means that all licensees required to post prices must do so using the online beer price posting system that is available now by the effective date which is approximately 30 business days from September 5, 2023. Additionally, any price promotions posted using the previous paper method that run beyond the effective date of this regulation must be discontinued and any new price promotions must comply with the regulations.
