Statement of Explanation

Proposed amendments to the Caterer’s Permit regulation.

The maximum number of authorized catering events to take place at a single premises in one calendar year has been changed from 24 to 36 in the proposed section 60.5(4).  The Department of Alcoholic Beverage Control is making this change to conform to SB 314 Section 23399(f) effective October 8, 2021. The department has no authority to change the number of catering events at a single premises per year to anything other than 36 because it is explicitly enumerated within the new law.

Notwithstanding any other law, The Department of Alcoholic Beverage Control, when adopting a measure under paragraph (2) of subdivision (c) may adopt those measures in accordance with Section 100 of Title 1 of the California Code of Regulations, and the measures shall be deemed to be a change without regulatory effect pursuant to paragraph (6) of subdivision (a) of that section and not subject to additional notice, procedural, or other considerations.
