Type 48 Licenses: New Signage and Product Requirements Take Effect July 1, 2025
As part of ongoing state efforts to protect patrons from being unknowingly drugged or becoming victim to other crimes that often ensue, Type 48 license holders will soon be required to, upon request, provide a lid with a customer’s drink. Type 48s must also update the mandatory signage on their premises related to drink spiking so that it provides notice about the availability of lids.

Beginning July 1, 2025, Type 48 license holders are expected to be in compliance with Assembly Bill 2375 (Lowenthal, Chapter 714, Statutes of 2025), a new law aimed at further preventing drink spiking, also known as “roofying.” This law requires Type 48 license holders and applicants (including those issued an interim operating permit) to make a drink lid available with a customer’s drink upon their request. The lid must either be free of charge or sold at a price that does not exceed a reasonable amount based on wholesale costs.
In addition to offering a lid, the licensee must post the following notice verbatim in a prominent and conspicuous location on their licensed premises:
“Don’t get roofied! Drink lids and drink spiking drug test kits available here. Ask a staff member for details.”

Violations of this law are not criminal offenses but may result in administrative citation against the license. While it is the obligation of the licensee to ensure lids are available, the lid is not required to fit all containers in which beverages are served on the premises but needs to fit at least one.

May a napkin be considered a lid?
No. For purposes of this law, a lid is a removable cover that attaches to the rim of a beverage.
How do I find lids that fit my glassware?
You are not required to have lids that fit all cups/glassware/containers in which beverages are served on the premises. If a customer requests a lid, the beverage should be served in a cup/glassware/container that the lid fits.
Does my current sign about drink spiking drug test kits need to be replaced with a new sign?
Yes. The signs must be updated, as stated in the advisory, to provide notice about the availability of lids. You may access a printable sign.
Will this law repeal on January 1, 2027?
It is currently scheduled to repeal on January 1, 2027. However, it is common for laws to have scheduled repeal dates that are subsequently extended. Check back on the Department’s website closer to the repeal date to verify the status of the law at that time.
