Hello,

I am a Californian who opposes the blanket approval in perpetuity of private enterprises such as restaurants taking up valuable sidewalk and street parking spaces for profit.

I understand the economic and employment value of temporarily allowing parklets during the COVID-19 pandemic. But to perpetuate or expand these obstacles to the movement of pedestrians and motorists is not feasible—and is undesirable. Parklets tend to be visually unattractive—even ugly—with little or no consistency in size or appearance. They interfere with roadway safety and pedestrian mobility when they take up public space on sidewalks and streets for private gain.

To make this problem permanent would be foolish and unfair. Do not extend or grant permanent approval for parklets in our streets.

Small businesses, bars and restaurants need support as we are trying to recover from the Pandemic – not more regulation and obstacles. Rule and regulation relief that was done during the Pandemic still applies today. We are still struggling. Please don’t kick us as we are trying to get up.

Dear ABC:

Regarding Licensing of Permanent non-contiguous areas, I have concerns and suggestions I implore you to consider. I know the proposed expansion program is well meaning, but in practical application, it may not be in the best interest in the community at large in some cases.

REASON FOR CONCERN:

Case in point: A very small sandwich shop with a beer license and a small outdoor patio was able to expand their seating during Covid, all the way out to the street. Their patron count has increased 5 to 10 fold which is great for any small business, however this particular business is located in a multi-tenant building containing a chiropractor, attorney, realty office, skin care and massage services, 2 salons, a retail shop and offices. Average size of other units is under 300 square feet.

When this sandwich-shop-turned-beer-pub received approval to expand their seating during Covid, what already was a worsening situation became unbearable. The building has 1 parking space per tenant available. This is disregarded consistently by pub patrons. The trash dumpster is now often full to overflowing and smelly, all businesses are invaded by flies and mosquitos so doors must remain closed or use net screening; the restrooms are overused and more reminiscent of a gas station than a quaint multi-tenant building with quiet uses.

Neither the building nor infrastructure were designed to handle constant traffic, and the restrooms which all tenants must share are disgusting. Used beer kegs are stacked in the parking lot since there isn’t room enough in the space to store them, the usual number of kegs typically stored outside has grown from 10 or so to a minimum of 20, maximum of 40. On occasion there are drunk patrons wandering the property, smoking, shouting, cheering and yelling at televised sports events, partying, creating disruptions to the other businesses…these disruptions have not been met with any concern for the health, safety, general welfare or the environment, outside of the monetary windfall the temporary expansion has garnered for the bar.

We have encountered people urinating in the planters and vomiting. The bathrooms cannot keep up with the patrons of the beer bar. It seems the business owner does little to control her patrons and seemingly does not monitor alcohol consumption. What used to be a nice sandwich shop-turned gastropub is now the equivalent of a raging party bus especially when there is a birthday party or sporting event on the outdoor and indoor televisions.

SUGGESTED PROCESS:

My suggestion for this new permanent licensing of non contiguous areas is that any business located in a multi tenant building be evaluated on a case by case basis with consideration of the location’s infrastructure, affect on and input from the stakeholder businesses that share the property as well as contiguous neighboring properties, before any permanent expansion can take place.

Take into account the age and infrastructure of the building and its intended built capacity, as well as the ability or inability of a business to contain and control their business activities, contain and control noise and contain patrons to their own space without affecting their neighbors. Please do not offer a blanket approval. Evaluate these on a case by case basis with the due diligence required for responsible business practices.

I suggest a check box be added to the application form asking if the business is located within a multiple tenant property or building. If YES, then ABC will perform further investigations and comprehensive vetting to determine suitability of the request, using the suggested questioning of other tenants and neighbors, and independently determining whether the current conditions of approval (CUP or AUP, and ABC conditions) are being complied with. Items to consider are:

Physical inspection of the premises to determine compliance with conditions of approval. If the business is out of compliance, the application should be denied since expansion exacerbates non compliant issues. This inspection would include any issues that would be contrary to the health, safety, general welfare or the environment (including but not limited to equipment and storage of alcohol and empty kegs, cleanliness, trash, runoff, noise, foul odors, vermin etc.

Questionnaires sent to stakeholders (contiguous neighbors and fellow tenants) should be with assurances of anonymity to avoid further conflict or confrontation, and include a instruction on how to report violations.

Businesses located in multi-tenant buildings who are in good standing with all codes and conditions resulting in good neighbor relations should/could be approved, with notice of determination to stakeholders.

The outdoor dining parklets are the best thing that happened to the city in the pandemic. It feels more European and friendly. It’s safer to be out still and many prefer that. It’s already expensive to operate restaurant in the city. Why make it harder?

We don’t need more parking, we need vibrant streets.

Outdoor dining is great — it’s a godsend for struggling businesses — and the current alcohol rules are not causing problems. (I live next door to restaurants and bars with parklets — the current system is working just fine.)

Please don’t give our restaurants any more red tape. The proposed regulations in section 70(d)(1),(3),(5),(6), and (7) could force good businesses to close, and we have enough closed storefronts here in SF already.
