Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 9:00am and 11:00pm Sunday through Thursday and 9:00am to 12:00am Midnight on Friday and Saturday.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

There shall be no live entertainment of any type, including but not limited to live music, disc jockey, karaoke, topless entertainment, male or female performers or fashion shows.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 11/12/21 and the ABC-253 dated 11/12/21.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 11/12/21 and ABC-253 dated 11/12/21.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 11/12/21 and ABC-253 dated 11/12/21.

Loitering is prohibited on or around these premises or this area under the control of the licensee(s) as depicted on the ABC-257 dated 11/12/21 and ABC-253 dated 11/12/21.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 48 hours of being applied.

The premises shall be maintained as a bona fide American food restaurant and shall provide a menu containing an assortment of foods normally offered in such restaurants.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.
