Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee(s) shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledge(s) that incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 08/18/2021 and ABC-253 dated 08/18/2021.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as depicted on the ABC-257 dated 08/18/2021 and ABC-253 dated 08/18/2021.

The licensee(s) or an employee of the licensee(s) shall frequently monitor the patio at all times that alcoholic beverages are being served or consumed. In this instance, “frequently” shall mean, once every ten minutes.

The boundaries of the patio will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries, as approved and designated on ABC 257, shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

There shall be no fixed or portable bar in the patio area maintained for the purpose of sales, service, or consumption of alcoholic beverages directly to patrons for consumption nor the for the purpose of a service bar,.
