Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 9:00am to Midnight Monday through Thursday, 9:00am to 1:00am Friday to Saturday and 9:00am to 10:00pm Sunday.

The premises shall be maintained as a bona fide eating place restaurant and shall provide a menu containing an assortment of foods normally offered in such restaurants.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 48 hours of being applied.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 04/02/20 and ABC-253 dated 04/02/20.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 04/02/20 and ABC-253 dated 04/02/20.

Loitering is prohibited on or around these premises or this area under the control of the licensee(s) as depicted on the ABC-257 dated 04/02/20 and ABC-253 dated 04/02/20.

Live entertainment provided shall be limited to recorded music, live bands, disc jockeys and patron dancing.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 04/02/20 and ABC-253 dated 04/02/20.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

WHEREAS, petitioner(s) has/have filed an application for the modification of existing conditions for the above-referred-to license(s)for the above-mentioned premises; and,

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

Petitioner(s) shall provide licensed uniformed security guards at all times during events at a ratio of one (1) licensed uniformed security guard per fifty (50) persons in attendance. A minimum of one (1) licensed uniformed security guard is required to be on duty at all times the business is open with the primary duty of patrolling, monitoring and reporting crime at the premises.

No “happy hour” type of reduced price alcoholic beverage promotion shall be allowed.

Petitioner shall not require an admission charge or a cover charge, not shall there a requirement to purchase a minimum number of drinks.

No distilled spirits shall be sold by the bottle.

No person under the age of 21 shall sell or deliver alcoholic beverages.

Alcoholic beverages shall be sold in single servings only. No "bucket sales" permitted.

Utilize a system to visually distinguish minors from those 21 years and older (i.e. Wrist bands or hand stamps)

The possession of alcoholic beverages in open containers and the consumption of alcoholic beverages is prohibited on or around these premises as depicted on ABC-253, dated 04/02/20.

No employee or agent shall solicit or accept any alcoholic or non-alcoholic beverage from any customer while in the premises.

Petitioner(s) shall make no changes in the premises interior without prior written approval from the Department.
